I have an appeal case coming up in the Employment Court. One aspect of the plaintiff’s case concerned ‘confidential information’.

Breach of confidence falls within the jurisdiction of Equity. One is almost tempted to say ‘common law’ which would of course be incorrect.

Anyway. Due to NZ having the Employment Relations Act 2000, the equity provision is s189(1).

This will require some extended research into this area of law.
